These terms govern your use of southernsky.ai (the site). The site is operated by Kristina Maree Agustin, trading as Southern Sky AI (ABN 73 107 743 069), from New South Wales, Australia. Southern Sky AI is an AI strategy and deployment company for the superyacht and marine industry. In these terms, "we", "us" and "our" mean Kristina Maree Agustin trading as Southern Sky AI. By using the site you accept these terms. If you do not accept them, please do not use the site.

What the site offers

The site publishes articles, reports, videos and reference material on AI in the superyacht and marine industry. It also describes our services, offers the AI Readability Check and the Chart Room Dispatch, takes call bookings, and verifies the training certificates we issue.

Content on the site is general information about AI, its regulation and its use. It is not legal advice, and it is not advice about your particular circumstances. Where legal advice is needed, it belongs with qualified counsel. Regulatory positions change, so check anything you intend to rely on against the source it cites.

Client engagements are governed by the proposal or agreement for that engagement. Where that document and these terms differ, the engagement document applies to the engagement.

The AI Readability Check

The AI Readability Check is a read of how AI systems can find and interpret the public pages of a website. It uses automated tools, and Kristina reviews the findings before your report is sent. The report is general information about your website at the time of the check. It is not a guarantee of how any search engine or AI system will treat your site, and it is not legal advice. Decisions you make from it are yours.

Request a check only for a website you are responsible for or have a legitimate reason to review.

Reports, downloads and certificates

You may read, download and print our reports and other content for your own organisation's internal use, and you may quote from them with attribution.

The certificate verification page confirms that a certificate we issued is genuine and shows the details recorded on it. It does not assess the holder beyond the course the certificate names.

Intellectual property

The site and its content, including articles, reports, videos, the Readability Check report format, page copy and design, belong to Southern Sky AI and its licensors. Beyond the internal use and quotation allowed above, you may not republish substantial portions of the content, offer it commercially, or present it as your own.

Acceptable use

Use the site as it is offered. Do not:

• probe, scan or test the vulnerability of the site or its infrastructure without written permission;
• attempt to access records, accounts or systems that are not yours;
• submit a form using another person's identity or email address;
• scrape, harvest or bulk-download content or data, other than through ordinary search engine and AI crawler access;
• use the site to transmit anything unlawful, or interfere with anyone else's use of it.

We may suspend or block access where these terms are breached, and where conduct appears unlawful we may report it.

Third-party links

The site links to third-party sites, including regulators and primary legal sources. We do not control them and are not responsible for their content or for how they handle your information. A link points you to a source and does not mean we endorse it.

Privacy

Our Privacy Policy explains what information the site collects and what we do with it. It forms part of these terms.

Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law, or under any other law that cannot lawfully be excluded.

Subject to that:

• The site and its content are provided as general information, without warranty that they are complete, current or suited to your circumstances.
• We are not liable for loss arising from reliance on site content or on a Readability Check report, from interruption or unavailability of the site, or from matters outside our reasonable control.
• Where liability cannot be excluded but can be limited, our liability is limited, at our election, to supplying the relevant service again or paying the cost of having it supplied again, and in any case is capped at the amount, if any, you paid us for the service the claim concerns.
• We are not liable for indirect or consequential loss, including lost profits, lost opportunity or business interruption.

Changes to the site and to these terms

We may change, suspend or retire parts of the site at any time.

When these terms change, the new version is posted on this page with a new date. Material changes take effect 30 days after posting, and continued use of the site after that date is acceptance. If a change is not acceptable to you, stop using the site and tell us.

Governing law

These terms are governed by the laws of New South Wales, Australia. Courts with jurisdiction in New South Wales have non-exclusive jurisdiction over disputes arising from them.
